Dealing with labour issues has always remained a Herculean task for Indian companies. Ask any factory owner from any part of the country and the majority will rank it as one of the biggest obstacles. Scores of central and state laws to comply with, dozens of forms to fill out, many strange-sounding norms to adhere to and the too powerful labour inspectors to keep satisfied . . . all play a major role in this curse. But now things may change a bit, with the government last week introducing a string of labour reforms,

These welcome measures, clubbed under an umbrella programme, Pt. Deendayal Upadhyay Shramev Jayate Karyakram, include a web portal which will be operative in four central organizations: Chief Labour Commissioner, Directorate General of Mines Safety, Employment Provident Fund, and Employees' State Insurance Corporation. For on-line registration, 6 lakh units in the country will be allotted a unique identification. Using this portal, the business units will be able to file self-certified and single on-line return for 16 out of 44 central laws.

In terms of labour inspection, under the new scheme a computer will now determine where an inspection will be carried out the next day and a factory inspection report will have to be loaded on-line within 72 hours (it cannot be modified thereafter). Needless to say, these measures will take away the discretionary powers of the inspectors, making the inspection process transparent. In addition, the government has also tried to reach out the employees by introducing easy portability for provident fund users and converging social security benefits on Rashtriya Swasthya Bima Yojana smart card. A scheme for training apprentices was also launched.

There is no doubt that these changes are too little to be sufficient. Critics point out that the government has plucked only some low hanging fruits, leaving the tougher issues unaddressed. Some of them also view that the reform measures will make little difference as long as the states do not respond to them. Truth is there in these views, but still it cannot be denied that these are some very positive changes and among the first to be attempted in over 50 years. I hope these first steps taken forward will be the beginning of bigger and even better things in the coming days.

Govt effort

This govt is taking effort in all directions, things are happening even in those area where nothing happened for last 50 yrs or so. So we should trust and support this govt, otherwise this is democracy, people will give another chance only based on performance now

Enrollment into the above scheme from day one an employee joins should be altered to after minimum one of year of service similarly a new start up should have a three year nasent oeriod before they get registered

Start saying labour as contributor will shift change in mindset towards their status. then all labour issues will be resolved in a different manner.

We are paying almost 7% of the Salary towards ESIC Premium. Though the scheme is good, in reality, the hospitals, the facilities are so bad that non of our employees wish to go to ESIC. There are no doctors available, no medicines available. Thus in spite of paying a huge premium, all the money is going down the drain. Neither the employer, nor the employee is interested in ESIC deduction, because, ultimately, if any accident happens, the employees go to private hospitals. In spite of paying ESIC premium, if employer does not help the employee in paying their private doctors bills, the employee gets a bad feeling about the employer. I do not wish that the scheme should be scrapped. However, it is very very essential to see that the ESIC Hospitals deliver the proper services and medicines. It is necessary to see that the doctors attend the hospitals.

I request government to change minimum of nine labours under factory act to 50 thus the listed industry will be reduced to one third and sme and micro units will be harassment free mostly in micro units they are one man show. mainly only one person manage finance,purchases, sales and other This way they will be relaxed.

we fully endorse that for factory act implementation the fig. 9 be increased to 50.this will be a matter of great relief to tiny small sector.


trade policy

we need a free trade policy for small and medium scale business people. There should be no tax for up to rs 1 to rs 6 crore No Vat / NO CST - Remove all check posts why do we pay different tax for within our nation? its no where in the world. collect all taxes from large and heavy scale industries. This will develop our nation with rapid growth. Do not avail free current & import subsidies for large scale industries. where as most Indians are not having electricity our villages. IF the new govt implement this than they will stand the govt for life long with no opposition.

Labour reforms are good but will not solve the all problems of labour. If you see in market that the unskilled labour wages are always higher than the minimum wages fixed by the Govt. Generally labours are not willing to deposit money in EPF as their day to day need of family is very essential. Minimum wages should be fixed on the basis of market wages at six monthly intervals on all India basis as our land circle rates are being fixed by DM in each district of India. Labour inspector raj should be vanished as early as possible. The Govt. introducing easy portability for provident fund users and converging social security benefits on Rashtriya Swasthya Bima Yojana smart card are very good schemes but it is up to employees to get their benefits. Illiteracy is a very big hurdle to get the benefit of govt schemes.These are some very positive changes and among the first to be attempted by the Govt. of India so state govt. ought to have support then only success could be achieved in this area, which is most neglected field.

More steps be taken on a continuing basis. let the issues be mutually agreed between employees: employers interse like any other agreements at one's free will.who the govt.is to impose restrictions in the name of age old and defunct laws causing impediments in the progress of our nation in such a globally competitive environment.

Nice reform taken by Govt. we all welcome . In my view There should be single window through which all all recruitments should made to all the private organisations,and this regulatory should be under control of government likely same as recruitments in government jobs. all disputes will automatically solved out.

Yes. it is a step in right direction. Better awareness of the whole system and its intent is essential. As much as the Govt machinery enforces what the employers are required to adhere to, they should also come up with measures to enforce what the employees are obliged to perform on their part as part of the enterprise. There should be a mechanism for both the employers and employees to record online (not just in-house record) any non-compliance or misdeed committed by the other without any bias. Govt officials should play the catalytic role to develop open-mindedness among everyone in the system. Their incentives should be adequately looked after by the Govt. and the officials - the whole hierarchy - should not yield to any pressure under any circumstance. Govts may change but the business enterprises should survive and the workforce cannot and should not be subjected to suffer because of wrong decisions or deeds on the part of the so called 'custodians' - the Departments whether it is in the administration of the Acts & Rules or the management of the large resource of funds saved by the workforce.


liberalisation of labor savings and insurance

Why should govt protect employee State insurance corporation and Public provident fund by making them compulsory. let labor select health insurane they are really going to use or mutual fund they would like to invest in. sometimes their current needs are higher than need for future savings. let them choose. ESIC hospitals are not best to get medical treatment from because of this protection.let them earn their bread way MSME sector is forced to compete against global imports.
